If you are unfortunate enough to be going through an incapacity case then having a disability lawyer you trust is even more of an issue. A disability case where a specialist lawyer has been employed by the claimant will be taken much more seriously and any organizations involved will tread more carefully,this is especially true when it comes to dealing with large organizations like Social Services and insurance firms. The purpose of hiring a disability lawyer is they know the process intimately and also the loopholes so can often expedite a case. This is particularly true if you are in an appeals process.
Most importantly, if you have already been denied benefits, you really do need some form of legal representation to assist you in the appeals processes. Feedback from previous clients they have represented are often available for everyone to see. They may well have previous cases similar to yours in their records for viewing. Alternatively, you may have friends that are able to recommend a reliable lawyer. Your life is in your disability lawyer's hands as much as it would be your doctors - both of these professionals have your life in their hands!
To help you with these criteria, you can disregard anyone with less than five years disability law experience. You will also need someone who has worked within your area on such cases for at least three years if you want a good shot at success. You need a disability lawyer who specializes in the area required who has experience in social security law or disability insurances and long term disability insurance. They must also spend at least 75 percent of their time practicing in this area of law. Good communication skills with both the client and the court are a necessity as well as truthfulness with his client. Remember, you will need to select about 2 or 3 laywers to interview, so that you have can assess which one not only has the experience but that you will feel comfortable working with.
If you do not feel happy doing this alone, take along a friend or relation to help you and write down information. While most laywers do not charge for an initial consultation but just like you, their time is important, Honesty from the disability lawyer is paramount if it is to proceed so you need to be clear on this point especially when it comes to the chances of success. If the relationship is to work there must be truthfulness between the both of you. Do not become dismayed if you do not find the right laywer immediately as the process can take some time.
