Divorce Lawyer
With marriage breakups happening every day, finding a divorce lawyer ready to take on a case isn't always easy. Ensure that your lawyer has at least the following attributes and abilities:
- Skilled in this area of law - Have the right attitude for this work - Be reliable
As far as experience is concerned, a lawyer should be able to show that at least half of their work involves divorce cases and have good negotiation skills as well. They must be someone you can trust and work with comfortably, someone who has your confidence.
Mediation minded lawyers are more likely to give you problem solving advice, whereas traditional lawyers tend to be more oriented to conflict and their advice tends to be adversarial. To save time, always ensure you know exactly what you are going to say to your divorce lawyer and what questions you need answered.
Make sure you know exactly what you intend to ask and record the answers as each time you contact your lawyer there will be a charge involved so note times dates and durations of conversations. Try to keep actual meetings to a minimum and where points have to be clarified, use the phone or send a letter.
Regard your attorney as a resource, not someone you depend on for emotional support because they cost too much for you to use them for sympathy and consolation, besides, you have family and friends for that. The behavior of your spouse, unless pertinent to the divorce, is of no concern to your divorce lawyer and will only distract them from the task at hand.
The most important aspect for you to get sorted out is the control of the situation which should be yours and then you will be able to use your lawyer more effectively. Tell them you want good advice and will rely on their experience, but that you expect to make decisions that concern the tone and strategy of the case. As the person paying for their service, you should expect to be sent copies of any relevant documents and if there are any issues that need to be clarified that a prompt response by them is expected.
If money is an issue, it may be a preferable for you to only contact a lawyer for legal advice on a marital settlement but not representation. In these circumstances you may only need to write down any issues you are unsure about and speak to your lawyer regarding those, and possible outcomes. Marital settlements are something that can be arranged by the individuals involved and then have them checked by a divorce lawyer. Then if things don't work out, the lawyer can always be hired to make the divorce settlement.
