ENVIRONMENTAL PRINCIPLES

Monday, July 21st, 2008

If you haven’t seen this yet, today I’m recommending this book. This title traces the evolution of environmental principles from their origins as vague political slogans to their embodiment in enforceable laws. It examines three principles: the polluter pays principle, the preventive principle and the precautionary principle, and their legal effect at the national, regional, and international levels. Without doubt this is one of the handiest law books the stores are stocking about this subject at the moment. The company who publish it are called OXFORD UNIVERSITY PRESS ,so I’m going to give it a relatively decent rating of 3.5 out of 5. It’s maybe not everyone’s cup of tea but it’s a book worth considering.

Lawyers

Sunday, July 20th, 2008

To become a lawyer, a person must be fully trained in the law of the country in which they reside; also known by the names, attorney or advocate, their role varies depending on the situation. When defending or prosecuting a person in court a lawyer will be called an advocate and this doesn’t matter if the case is civil or criminal; whilst they are able to appear in court to represent their clients some prefer this work more than others. When employed to provide advice on the law they are known as legal advisors; when a client has legal problems that requires available options, they can provide recommendations.

Those who specialize in courtroom procedure are called trial lawyers; it requires a more confident type of personality, someone who is quick thinking.Much of a trial lawyer’s work is actually performed outside the courtroom environment; much of the work involved is looking into the case with interviews, statements and evidence plus legal procedures to check and follow.

The law in all its guises affects every aspect of modern society; whether buying a home to crossing the street, lawyers hold positions of great responsibility and are obliged to follow a strict code of ethics. Depending on what area of specialization they work in will decide whether they practice in a courtroom; although they are all able to represent their clients in this manner when required.

Lawyers can specialize in a number of different areas of society; such as:

*Intellectual Property Rights *Criminal Law *International law *Marine Law *Fraud

The need to practice every area of law in a courtroom is minimal!

Environmental law for instance employs experts who will represent private, government and individuals; an example of this group could be:

*Public-Interest Groups *Utility Companies *Airports

Often this work will be mundane as it involves planning applications and licenses for example; however, they also protect companies where claims for damages are being sought.

A growth area for attorneys in recent years is that of intellectual property rights; an area that has increased owing to the use of digital products; music and video for example. Legal departments within insurance companies also employ specialist lawyers; writing insurance policies, investigating claims protecting company assets are just a few areas where their knowledge is useful.

Despite these different areas of legislature, most attorneys will practice in the field of either criminal or civil law; criminal lawyers represent people charged with crimes whether for defense or prosecution; civil law uses their talents to argue in a civil court over claims, mortgages and other types of litigation.

Close to the top of the ladder are those legal specialists that manage what are known as high profile ‘public interest’ cases; these can include law suits and legal representation that affects the general public for instance. A few lawyers decide to use their knowledge to help the defense and rights of those less fortunate in foreign countries; this type of work is more about helping those are not able to have legal representation any other way.

Bankruptcy Lawyers

Sunday, July 20th, 2008

There are times when then is no option but to file for bankruptcy and during this time, your best friend will be the bankruptcy lawyer; this will be an extremely stressful time for many people as their whole life is about to change. Owing to the recent changes in the law, filing for bankruptcy preparation does take a little longer but an attorney can complete the process much more quickly and efficiently. Although the amendments to the bankruptcy law are designed to eliminate the time wasters, no other real changes have been made. Once debtors have overcome this hurdle they should be able to proceed as normal.

One important thing to remember is that most individuals who file for bankruptcy protection don’t lose any property as the U.S. bankruptcy code provides exemptions. These exemptions allow you to keep a certain amount of value in large property like your home and an automobile. In addition to this there are extensive exemptions for clothing, furniture, and personal property.

Of course each State has its own exemptions which may or may not go beyond federal ones so your bankruptcy lawyer must be aware of these in advance of your petition. The fact is that the vast majority of individuals filing for bankruptcy are not wealthy. They do not own large value items or have money hidden away. It is important that what they do have is protected from their creditors as much as possible.

However, your bankruptcy will be on your personal credit history record for 10 years but that is not all. In fact the primary points on the credit scoring system are based around your more recent financial history and not on transactions made some time ago. This is the reason why not long after you have been made bankrupt, a whole host of companies offering credit will start contacting you, but you must be very careful at this time.

There are a number of unscrupulous companies that will wish to give you credit. The rates they want to charge will be much higher than normal and there may also be additional charges. If you are not careful, you could find yourself in debt once again. Do take advice from your bankruptcy lawyer. If you only accept credit deals that you can handle comfortably and you always pay more than the minimum amount, your credit history will start to rebuild itself.

Fortunately most people who are able to keep their bills current after bankruptcy are able to re-establish their credit in 2-4 years, which is a relatively short period of time. Although it will still appear on your credit record, the bankruptcy should not affect the chances of you buying a house or arranging other unsecured loans, providing you keep your credit record clean.

Bankruptcy is not a crime although many credit institutions like to promote the idea that it is only wasters and failures that become bankrupt. Whilst this incorrect and harmful attitude continues, many people will struggle unnecessarily with their finance rather than become bankrupt. This belief also makes it easier to get support for legislation that will make it harder for people to become insolvent. Don’t be fooled though, because your bankruptcy lawyer will tell you that most people that file for bankruptcy protection have just been unlucky and never had any intention of this happening.

Adoption Lawyer

Wednesday, July 16th, 2008

Adoption lawyers are a significant aspect in any adoption procedure; they assist prospective parents in avoiding any adoption complications. A specialist legal representative can provide a degree of success that untrained applicants could never achieve; this is an area of law that doesn’t take the actions of novices seriously - however well meaning. People wishing to adopt must be prepared to provide written documentation to the court; these procedural requests are just to ensure the adoption is lawful.

Some parents try to carry this aspect out without representation; in the interests of speed and efficiency it is much wiser to use the services of a professional lawyer, versed in adoption law and practice. Towards the end of the first year of the child’s placement with their new parents, a completion meeting is called and it would be worthwhile employing a lawyer to help the process along. Of course another option is too find an adoption agency that can help but be aware that it is more than likely they too will use an adoption lawyer to help with the process.

Many adoptions are made internationally and in these instances it is necessary for a lawyer to be present as the laws vary from country to country. Not only that but it is not likely that prospective parents would be able to read or understand any documents in a foreign language, in particular those of a legal nature. Parents adopting a child from another country will need the help of an adoption attorney able to translate foreign adoption papers; any couple serious about adoption will know they cannot realistically proceed without one.

Of course one of the most important aspects is that of citizenship; this is something where they will have no choice but to employ the services of a legal representative. As adopting a baby or child can be an emotional time, it is the adoption lawyer that will not only bring their skills but also a sense of calm to the situation. They are familiar with the legal issues related to the process and they are knowledgeable about loopholes and possible mistakes that are common in adopting a child.

To serve their clients, adoption agencies will ensure even if they do not have a full time adoption lawyer working for them they will have access to one who is trusted. This is why using an agency can often be an advantage to couples seeking to adopt a child; this saves them the often difficult process of finding an adoption attorney of their own. Unless the legal matters are addressed and taken care of properly however, prospective parents may face problems with their adoption; a lawyers service can provide a reassurance that vulnerable parents require.
