Accident Law

Tuesday, August 26th, 2008

Of all the professions in the United States where danger is involved it is the construction industry that is the most hazardous to health; these professionals are often unrecognized for the dangerous work they perform. New York is so far the only State to try and reduce the number of accidents by changing the law; as a consequence there has been an increase in the number of accident lawyers practicing. Almost every type of construction site injury is serious but falls are those that happen most often; but there are many others, including injuries caused as a result of defective machines/equipment or electrocution for example.

If you are unfortunate enough to work on a construction site and be injured, then all the facts relating to the accident fully documented; this should be carried out as soon as possible after the event so the memory is fresh. This will increase your chances of a successful compensation claim as it is easy to pick holes in an incomplete record of events; never underestimate the importance of this.

It should read a little like a police report with the what, when, where and how sections completed; for instance:

*Location, date and time of the incident *What type of machinery was being used? *Has the equipment caused any other injuries? *Recent inspection report of the machinery *Contact details of anyone who witnessed the accident *Was the weather partly responsible?

Write down every aspect of the event; your accident lawyer will need all that information and it will help them build a stronger case!

Once all the information has been gathered you will need to locate a good lawyer, preferably someone with experience in accident compensation claims; this way you should expect superior results with any compensation claim you make. Remember you have had an injury that wasn’t your fault; the other party will probably have engaged a professional accident lawyer to defend them so you will need to do the same if you hope to win.

Unfortunately, the law forbids any legal suits against employers; this does not mean that others cannot be held responsible for negligence or faulty equipment and these people or companies can be prosecuted. This can include, third-party contractors, property owners, and equipment manufacturers; the law does allow claims to be made against other companies involved in the construction industry

If you are a construction worker in the State of New York you should consider yourself lucky as you have the law on your side when it comes to safety issues; they have made it known that claims will be made against contractors and property owners who do not keep their sites safe. Subcontractors will also be held responsible especially when they have supplied their workers with dangerous or faulty equipment that caused the accident. Compensation can also be sought from the equipment manufacturers if the injury was the result of faulty equipment; your accident lawyer will advise you on the next course of action. The best advice would be to seek a company that has made successful claims in the past who aware of the laws surrounding construction site injuries; it is more likely a firm that deals exclusively in this type of law will serve you better.

Adoption Lawyer

Sunday, August 24th, 2008

The adoption process can be lengthy and complex, for which a professional adoption lawyer is the person best suited; they can help couples understand the different options available to them. Applicants acting without legal assistance would not be likely to complete the process; because the prospective parents, will require complete rights to the adopted child. Whilst there are many steps to any adoption, one of the most important is the information supplied to the courts relating to the application; this request will probably require information relating to the child’s birth certificate and any other related details.

It is actually possible for the new parents to submit these details themselves although this might not be the best way forward; it would however, be much simpler to employ a lawyer who is familiar with the adoption process and less likely to make mistakes. During the finalization process of the adoption, it might help to have a lawyer present as the adoptive parents must attend a hearing which usually takes place within the first year after a child is placed in their new home. Adoption agencies and non-profit adoption organizations will probably have their own adoption lawyers who are aware of the legal requirements necessary to complete an adoption.

Those couples who choose to adopt a child from another country also face difficulties and should not attempt this without the help of a lawyer especially when the laws are different in each country. Not only that but it is not likely that prospective parents would be able to read or understand any documents in a foreign language, in particular those of a legal nature. For this very reason alone an adoption attorney who deals with international adoption will be in a position to translate these documents; some couples just don’t understand how huge the task is internationally without their help.

There are many details to sort through with adoption, especially foreign adoption including details such as citizenship; this is something where they will have no choice but to employ the services of a legal representative. The knowledge and skills an adoption lawyer can supply are immeasurable and will make the difference between a successful adoption and a failed attempt. They are familiar with the legal issues related to the process and they are knowledgeable about loopholes and possible mistakes that are common in adopting a child.

To serve their clients, adoption agencies will ensure even if they do not have a full time adoption lawyer working for them they will have access to one who is trusted. This would definitely be an asset when using an agency to adopt; this usually eliminates the worry of finding a good adoption attorney for prospective parents. There are past cases where prospective parents have believed they had completed the procedure and were legal parents when that was not the case at all; therefore, the assistance they receive from their lawyer is invaluable.

In America, one profession more than any other has a danger attached to it like no other – that of the construction worker; giving them a greater risk of serious injury than any other occupation. To deal with the situation, New York State has created new laws to govern construction and related industries; which has seen an increase in accident lawyers. Many types of accidents happen on any site but it is falls that occur most frequently; although, fires, explosions, serious cuts and welding accidents are all life threatening.

It is important that when an injury or accident happens, information about the incident is documented; the sooner this is done the better. The better the documentation of events and how they occurred, the greater the chance of obtaining a successful compensation claim for an injury; many victims do not fully realize just how necessary this is.

It should read a little like a police report with the what, when, where and how sections completed; these facts could include details such as:

*When and where it happened *The machinery involved in the incident *Any problems with the equipment *Equipment inspections *Contact details of anyone who witnessed the accident *Could the weather have had an effect?

It is necessary to supply them with every fact no matter how small; your accident lawyer will need all that information and it will help them build a stronger case!

Finding an attorney that is a specialist in accident law is your best way forward as this is their area of expertise; this is a sure way to improve your chances of a win. Remember you have had an injury that wasn’t your fault; the legal representative for the other side will be a professional accident lawyer so you need to employ the same.

Unfortunately, the law forbids any legal suits against employers; other people or companies however, can be held accountable for accidents on a construction site and be prosecuted. For example contractors, owners of property, equipment manufacturers and suppliers are in this category; anyone who is defined as a third party operator can be sued for injury compensation.

New York State made a bold move when it developed laws to protect construction workers; they have made it clear that the site owner and contractors must ensure the site is a safe working environment. With these laws, no-one should really escape, not even subcontractors. It is also possible to pursue negligent construction equipment suppliers if it is found that injuries and accidents are the result of unsafe equipment they supplied; in cases like this you can be advised on your next step by your accident lawyer. Fortunately for any construction worker in the State of New York, the law is very definitely behind them; they have stated that the responsibility for safety on the site is down to the owner and general contractor.
